Controlled Substances Inventory Management: Returns, Disposal, and Recalls

A practical guide to handling overstock, expired, damaged, and recalled controlled substances while maintaining compliance, accurate records, and preventing diversion

Proper inventory management of controlled substances is essential to ensure regulatory compliance, prevent diversion, and maintain accurate records. This guide outlines best practices for returning, disposing of, and managing controlled substances inventory. 

 

Wholesaler Returns 

Controlled substances may be returned to a wholesaler under certain circumstances, including: 

  • Overstock inventory  
  • Accidental orders  
  • Short-dated products received  

Key Steps: 

  • Segregate and secure items designated for return  
  • Initiate the return according to wholesaler requirements  
  • For Schedule II substances, wait for and complete a DEA Form 222 before processing the return 
    • DEA Form 222s are only valid for 60 days after the execution date  
  • Generate a return invoice including:  
    • Date of transaction  
    • Drug name, strength, dosage form, and quantity  
    • Pharmacy name, address, and DEA number  
  • Once the return is complete, the pharmacy (as the supplier) must send a copy of the DEA Form 222 to the DEA by month end of the purchase date.  

Documentation & Recordkeeping: 

  • Update inventory and perpetual logs to reflect the return  
  • Maintain return invoices, DEA Form 222 (if applicable), and credit documentation  
  • Ensure all records are readily retrievable for at least 2 years  
  • Schedule II and Schedule III–V records must be filed separately  

 

Returning Expired Controlled Substances 

Expired controlled substances should be: 

  • Removed from active inventory before expiration  
  • Secured in a designated area until return  

Return Process: 

  • Send expired products to a DEA-registered reverse distributor  
  • For Schedule II substances:  
    • Obtain and complete a DEA Form 222 before shipping  
    • DEA Form 222s are only valid for 60 days after the execution date  
  • Generate and verify return documentation (same requirements as wholesaler returns)  

Post-Return: 

  • Confirm receipt and obtain credit documentation  
  • Update inventory and maintain all records for inspection  
  • Once the return is complete, the pharmacy (as the supplier) must send a copy of the DEA Form 222 to the DEA by month end of the purchase date.  

 
 

Disposal of Damaged or Unsaleable Controlled Substances 

Controlled substances that cannot be returned must be destroyed in a non-retrievable manner (incineration is the only currently approved DEA method of destruction). 

Disposal Options: 

  1. Onsite Destruction
  • Use a DEA-approved destruction method  
  • Two employees (one pharmacist) must:  
    • Handle and observe the process  
    • Witness destruction  

Documentation: 

  • Complete DEA Form 41 (kept on-site unless requested) in a readily retrievable manner for at least 2 years  
  • Update inventory records with:  
    • Date  
    • Reason for destruction  
  1. Reverse Distributor Disposal
  • Transfer substances to a DEA-registered reverse distributor  
  • For Schedule II substances:  
    • DEA Form 222 is required before shipment 
      •  DEA Form 222s are only valid for 60 days after the execution date  
    • Once the return is complete, the pharmacy (as the supplier) must send a copy of the DEA Form 222 to the DEA by month end of the purchase date.  

Process Includes: 

  • Generating return documentation  
  • Verifying shipment and credit  
  • Updating inventory records accordingly  

 
 

DEA Form 222 Requirements (Schedule II) 

DEA Form 222 is required when: 

  • Returning Schedule II substances to wholesalers or reverse distributors  

Important Notes: 

  • The form is valid for 60 days from execution  
  • Expired forms must be voided and documented  
  • Copies must be retained and submitted to the DEA as required  
  • Maintain forms in a readily retrievable format  

 

Recordkeeping Requirements 

For all returns, transfers, and disposals: 

  • Maintain:  
    • Return invoices  
    • DEA Forms (222 and 41 as applicable)  
    • Credit confirmations  
  • Ensure records are:  
    • Accurate  
    • Organized  
    • Readily retrievable  
  • Retain all records for at least 2 years  
  • Separate Schedule II records from Schedule III–V  

 

Managing Product Recalls 

In the event of a recall: 

  • Follow instructions provided in the recall notice  
  • Return the product to the designated wholesaler or reverse distributor  
  • Follow the same documentation, inventory adjustment, and recordkeeping procedures outlined above  

 

Best Practices for Compliance 

  • Always secure and segregate controlled substances awaiting return or disposal  
  • Reconcile physical inventory with system records after every transaction  
  • Monitor DEA form usage and expiration timelines  
  • Maintain consistent documentation practices across all staff  
  • Regularly audit records to ensure completeness and accuracy
